Working paper on responsibility sharing

This working paper examines the meaning of solidarity in the context of asylum, usually debated under the term ‘responsibility sharing’. It aims to examine EU Member States’ understanding of solidarity in the context of asylum. In particular, it will investigate the EU’s initial position on solidarity among the Member States of the EU, and whether this approach has shifted over the years and in the course of the last waves of enlargement of the EU in 2004, 2007 and 2013.

WP2 Chapter for the final report

Based on the research within WP2, this deliverable summarizes the main research questions, methodologies and results.

AIDA comparative reports

The report will follow the AIDA framework and provide comparative analysis of the country studies.

Cross-national comparative report

Based on the data generated from tasks 5.1 to 5.3, the deliverable will identify different patterns of politicisation among EU countries and tanalyse the main drivers as well as possible consequences. In terms of drivers, we will consider under what conditions politicisation has developed in different countries. In terms of consequences, the key question is to what extent different patterns of politicisation explain different Member State positions on responsibility sharing, especially in relation to relocation schemes. The focus on both drivers and consequences will allow us to understand how the insight and contextual understanding of discourses can be translated into the development of proactive strategies (e.g. in the field of communication, civil society, education, etc.).

Report on the importance of the local level as a venue and political base for the CEAS

The deliverable report the results of a comparative analysis of research results, establishing which, and how, ideal models arising out of the literature study (WP1) and the empirical analysis (WP2-6) of CEASEVAL resonate with the stakeholders. A specific focus is given to the local level as a venue and political base for the CEAS.

Presentation of final results at the final conference in Chemnitz

The deliverable presents detailed models for a sustainable CEAS that would optimally satisfy the goals of refugee protection within the EU, with due consideration for Member States’ needs for equitable outcomes.

Report containing the detailed models for a sustainable CEAS

The deliverable will draft detailed models for a sustainable CEAS based on the research andstakeholder discussions convened within this WP. Detailed sustainable models will be arranged according to the primary goals each model seeks to accomplish, integrating scenarios differing in the extent and levels of harmonisation of the CEAS, and based on the results of the state-of-the-art review (WP1) and empirical analysis (WP2-6) realised in CEASEVAL.

Comparative and synthesis report

Comparative and synthesis report on the interactions between borders and the mobility of migrants (‘irregular migrants’, asylum seekers and refugees), informed by the empirical case studies. Based on the case study findings, the deliberable will critically reflect and discuss how bordering processes are implemented when confronted with the mobility of migrants at different stages, such as interception before entry into the Schengen area (e.g. at sea), ‘illegal’ entry at external borders, ‘irregular’ transit, and secondary movement across internal borders after making asylum claims or being granted status.

Annotated bibliography of academic/policy analysis on asylum in the EU

The annotated bibliography will result from a bibliographic review of academic research into the common EU asylum system, with a particular focus on the politicisation of immigration and refugees in Europe and discussions on ‘burden sharing’ mechanisms. This will focus on all publications in academic journals since 2000 and incorporating working papers and public reports published since 2010. These will be collected into a shared annotated bibliography.

Report on ideal-typical CEAS models

Starting from the needs of refugees as the core issue, the deliverable drafts several scenarios by which the CEAS could produce optimal protection results, while also achieving solidarity and equity between Member States. ‘Equity’ in this equation can be defined in alternative ways, e.g. as an outcome of equal numbers, costs, benefits, or realised by means of ‘side payments’. This exercise will be informed by the outcomes of the state-of-the-art literature review of WP1, as well as empirical analysis of WP2-6. ECRE and Universiteit van Amsterdam will perform this task jointly.

WP4 Policy brief

WP4 Policy brief will summarize the findings of WP4 with relevance for key stakeholders in the field of bordering and mobility of migrants.

The deliverable presents six case studies reports of good practice examples of shared responsibilities in the CEAS framework between one or more EU Member States, as a result of the research carried out within Task 6.1-6.3.

State-of-the-art report on public attitudes, political discourses and media coverage of the arrival of refugees, as well as EU and Member States’ responses

Based on the annotated bibliography and the literature review, a state-of-the-art report is created, reflecting public attitudes, political discourses and media coverage of the arrival of refugees, as well as EU and Member States’ responses.

International final conference held in Chemnitz

International final academic conference held in Chemnitz, aiming at disseminating academic output and policy recommendations.

Report on the effectiveness of harmonisation of the CEAS, based on the different harmonisation tools

Following the AIDA methodology, the effectiveness of the legal harmonisation will be assessed and analysed with a focus on the national implementation of CEAS legislation, the interpretation of EU law by the Court of Justice of the EU, relevant jurisprudence of the European Court of Human Rights (ECHR), at the national level, including in selected non-EU countries. The evaluation of the implementation of the instruments of the CEAS will be approached through four core themes: 1) asylum procedures, including the operation of the Dublin System; 2) reception conditions for asylum seekers; 3) detention of asylum seekers, and; 4) content of international protection.

National reports on the governance of the asylum reception system in Germany, Italy, Greece, Spain, Bulgaria, Luxembourg and Finland

Mapping the formal governance structure of the national reception systems. Through the analysis of official documents, mapping the formal governance structure of the national reception system, i.e. the articulation of the reception systems, competences and tasks of the actors at different levels (national, regional, local) and formal decisionmaking procedures and venues. Case studies: Germany, Italy, Greece, Spain, Bulgaria, Luxembourg and Finland

Working paper reviewing quantitative and qualitative analysis of publications

The working paper will review the quantitative and qualitative analysis of publications carried out in WP 1 and report about main outcomes and implications.

Working paper on solidarity

The working paper examines the meaning of solidarity in the treaties, its evolution as a legal concept in EU law and its interpretation in different fields of EU policymaking, both in an academic context as well as in practice.

National reports (Finland, Germany, Bulgaria, Hungary, Spain, Italy, Greece and Turkey)

The deliverable will report on the differentiated patterns of politicisation on the arrival of refugees and on EU, Member States’ and non-Member States’ policy responses in 7 EU countries and 1 non-EU country (Finland, Germany, Bulgaria, Hungary, Spain, Italy, Greece and Turkey) from April 2015 onwards.

Baseline CEAS study on access to protection and distribution of asylum seekers, the determination of asylum claims and the reception of asylum applicants

Baseline study summarising the academic work, studies, evaluations and the developments of: 1) The access to protection and distribution of asylum seekers across EU Member States, i.e. work on resettlement and complementary pathways providing access to protection in the EU, on Dublin, on the Council Decisions on relocation (Council Decision (EU) 2015/1523 of 14 September 2015 and Council Decision (EU) 2015/1601 of 22 September 2015), on hotspots, on temporary protection, etc., 2) The determination of the status of asylum applicants (Procedures and Qualification Directive/proposal for a Regulation), and 3) The reception of asylum seekers (Reception Directive and its new proposal).

WP5 Policy brief

The deliverable reports on main findings with specific relevance for stakeholders in the field of policy making and make recommendations how to reduce politicization of the refugee discourse and how to facilitate a more fact-based and EU solidarity-based response.

Four case studies reports of good practice examples of shared responsibilities of EU Member States with third countries

The deliverable will present four case studies of good practice examples of shared responsibilities of EU Member States with third countries, derived from the research carried out in tasks 6.1-6.3.

Thematic paper on “Options for a common asylum system (harmonisation – regionalisation – externalisation)”

Based on task 2.3, a thematic paper is prepared shedding light on key features of the CEAS and generating results for further work on scenarios under WP 7. The paper analyses three options of a “common European asylum system”, representing the most dominant current streams of a potential future: a) ‘harmonised’, b) ‘regionalised’, and c) ‘externalised’. It discusses the options along considerations on the institutional set up of the CEAS and examines the gradual and increased proposed shift of asylum policy making from the national to the EU-level, and its perception by policy-makers and stakeholders, thus looking into: a) Nationalised European Asylum System, b) a shared (EU+ Member States’) Asylum System, and c) a centralised EU asylum system (e.g. EASO++).

Comparative report on the multilevel governance of the national asylum reception systems

Mapping and analysing the stakes, goals, resources and strategies of the actors involved at different levels (national, regional, local), the role they played in the decisionmaking process beyond their formal tasks and their mutual relations, and the contextual factors which affect the reception systems. In the case of Italy and Greece, hotspots will also be considered. As for the local level, in each country, 2 different localities with a high level of heterogeneity (in terms of population size, ruling parties, size of the third sector, similar share of asylum seekers or refugees, etc.) have to be considered. Each partner involved will undertake 20-25 qualitative in-depth interviews with key informants, in particular policymakers, high-ranking public officials, leaders of non-profit organisations, representatives of immigrant/refugee associations if relevant. Case studies: Germany, Italy, Greece, Spain, Bulgaria, Luxembourg and Finland

Report on secondary movements

Elaboration of secondary movement across internal borders after making asylum claims or being granted status, based on the research results of the country case studies within WP4.

Policy brief with policy recommendations on the harmonisation of reception

The evidences on factors driving convergence and divergence between national reception systems as well as elements explaining internal heterogeneity within Member States will be discussed in a stakeholder group meeting with policymakers and NGOs to be held in Turin and will feed into policy recommendation within the WP policy brief.

Country reports for Turkey, Greece, Spain, Hungary, Germany, France and Luxembourg, focussing on the question of how bordering processes are implemented when confronted with the mobility of migrants at different stages, such as interception before entry into the Schengen area (e.g. at sea), ‘illegal’ entry at external borders, ‘irregular’ transit, and secondary movement across internal borders after making asylum claims or being granted status.

New policy database focusing on variables relevant to asylum applications in both sending and receiving countries

The deliverable consists of a new policy database, drawing on existing policy databases and new analysis, with the aim of quantitatively testing the influences on changes in asylum applications across the EU since 2000.

Mapping of current asylum situation in EU Member States

This deliverable will map the current situation of asylum law across the EU. This will provide a simple quantitative measure of the current state of transposition of key directives into national law. This will build on the Asylum Information Database (AIDA), established by ECRE, slightly expanded to ensure that all CEASEVAL case studies will be covered. ECRE will review this document once it has been produced by UOS.
